1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and vsl.im ("Company," "we," "our," or "us") governing your access to and use of the vsl.im website, API, and all related services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you do not have permission to access the Service.

2. Description of Service

vsl.im provides a URL shortening and link management platform that allows users to:

• Create shortened URLs from longer web addresses
• Track analytics and statistics for shortened links
• Customize short links with custom aliases
• Use custom domains for branded short links
• Generate QR codes for links
• Access the Service via web interface and API

3. User Accounts

3.1 Account Creation

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

3.3 Account Eligibility

You must be at least 16 years old to use this Service. By using the Service, you represent and warrant that you meet this requirement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Acceptable Use Policy

4.1 Prohibited Content

You may not use the Service to shorten URLs that link to content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
• Contains malware, viruses, or other malicious code
• Promotes phishing, fraud, or scams
• Infringes intellectual property rights of others
• Contains child sexual abuse material (CSAM)
• Promotes violence, terrorism, or self-harm
• Constitutes spam or unsolicited commercial communications
• Violates applicable laws or regulations

4.2 Prohibited Activities

You may not:

• Attempt to probe, scan, or test the vulnerability of our systems
• Circumvent any security or access controls
• Interfere with or disrupt the Service or servers
• Use automated means to access the Service beyond authorized API usage
• Resell or redistribute the Service without authorization
• Use the Service to send spam or unsolicited messages
• Create links for the purpose of misleading users about their destination
• Impersonate any person or entity

4.3 Enforcement

We reserve the right to investigate and take appropriate action against anyone who violates this Acceptable Use Policy, including removing content, suspending or terminating accounts, and reporting to law enforcement authorities.

5. Intellectual Property

5.1 Our Rights

The Service and its original content (excluding content provided by users), features, and functionality are owned by vsl.im and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

5.2 Your Rights

You retain ownership of any content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display that content solely for the purpose of providing the Service.

5.3 Trademarks

"vsl.im" and our logo are trademarks of the Company. You may not use these marks without our prior written permission.

6. Service Plans and Payments

6.1 Free and Paid Plans

We offer free and paid subscription plans. Features and limits vary by plan. Current plan details are available on our pricing page.

6.2 Billing

Paid plans are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all fees incurred.

6.3 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access until the end of your current billing period. No refunds are provided for partial periods, except as required by law or as stated in our refund policy.

6.4 Refunds

We offer a 14-day money-back guarantee on initial subscriptions. To request a refund, contact support within 14 days of your first payment. Renewals and upgrades are not eligible for refunds.

6.5 Price Changes

We may change pricing with 30 days' notice. Price changes will not affect current subscription periods.

7. API Terms

7.1 API Access

We grant you a limited, non-exclusive, non-transferable license to access our API subject to these Terms and our API documentation.

7.2 Rate Limits

API access is subject to rate limits based on your plan. Exceeding rate limits may result in temporary blocking or account suspension.

7.3 API Changes

We may modify the API with reasonable notice. We will maintain backward compatibility where practical and provide migration guidance for breaking changes.

8. Custom Domains

8.1 Domain Requirements

You must own or have authorization to use any custom domain you register with our Service. You are responsible for maintaining domain registration and DNS configuration.

8.2 Domain Content

You are solely responsible for all content served through your custom domains and must ensure it complies with these Terms and applicable laws.

9. Disclaimers

9.1 Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

9.2 No Guarantee

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Results obtained from the Service will be accurate or reliable
• Any errors in the Service will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL vsl.im, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to defend, indemnify, and hold harmless vsl.im and its licensees and licensors, and their employees, contractors, agents, officers, and directors from any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

• Your use of and access to the Service
• Your violation of these Terms
• Your violation of any third party right, including intellectual property rights
• Content you create, submit, or link to through the Service

12. Termination

12.1 Termination by You

You may terminate your account at any time by using the account deletion feature or contacting support.

12.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if you breach these Terms or for any other reason at our sole discretion.

12.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Dispute Resolution

13.1 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us. We will try to resolve the dispute informally by contacting you via email.

13.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is incorporated, without regard to its conflict of law provisions.

13.3 Arbitration

Any disputes arising out of or related to these Terms or the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property infringement.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and vsl.im.

14.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the new Terms and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
